On 30 May, we hosted a seminar, presented by Rajah & Tann Singapore LLP on the recent 2017 amendments to the FIDIC suite of contracts. The 2017 amendments have brought about greater parity between employer and contractor in terms of risk allocation and users have seen more guidance and specificity in the provisions, particularly those relating to claims and dispute avoidance/resolution. Comparing the FIDIC DAAB system with the adjudication process under the Building and Construction Industry Security of Payments Act (Cap. 30B) (“SOP Act”), the users of the 2017 FIDIC suite can expect access to what is an almost private and personal dispute resolution system to resolve a far wider range of disputes than the SOP Act was envisioned to cover.
